The short version. We collect the details you give us when you request a build slot, plus limited technical data needed to run the site. We use it to manage your reservation and, only if you ask, to send program updates. We don't sell your personal information. You can see, correct or delete it, or opt out, at any time.
1. Who we are
This website, roadster-presale.us (the "Site"), is operated by Roadster Presale ("we", "us" or "our"). We are responsible for the personal information described in this Privacy Policy. Our contact details are in section 17.
This policy applies to personal information we collect through the Site, through our emails and when you contact us. It does not apply to third-party websites or services we link to, which have their own privacy policies.
2. Notice at collection
When you submit a reservation request we collect your name, email address, ZIP code and state, and optionally your phone number and vehicle preferences (specification, color and gearbox). When you browse the Site, our hosting provider automatically processes technical data such as your IP address and browser type. If you allow optional cookies, we also collect usage data.
We use this information to manage your reservation, communicate with you, plan production, keep the Site secure and, if you opt in, send program updates. We keep it for the periods set out in section 8. We do not sell personal information. We "share" personal information for cross-context behavioral advertising only if you switch on marketing cookies, and you can opt out at any time on Your Privacy Choices. We do not collect sensitive personal information.
3. Information we collect
Information you give us
- Reservation details: first and last name, email address, phone number (optional), ZIP code and state.
- Vehicle preferences: preferred specification, color and gearbox.
- Consents and choices: confirmation that you are 18 or older, acceptance of our terms, and whether you opted in to program updates.
- Communications: the content of emails and messages you send us, and any information you include in a privacy request.
Information collected automatically
- Technical data: IP address, browser and device type, operating system, referring page, and the date and time of your visit. Our hosting provider processes this data to deliver pages and protect the Site against abuse.
- Cookie data: a strictly necessary cookie that records your cookie choices. Analytics and marketing cookies are used only if you allow them. See our Cookie Policy.
- Email engagement: if you receive program updates, we may record whether an email was delivered and opened, so we can manage our mailing list.
Information from other sources
We do not buy personal information. Our service providers may give us information about email deliverability (for example, when an address bounces).
4. How we use your information
- To manage your reservation: record your place in line, confirm your request, invite you to configure your car and respond to your questions.
- To communicate with you: send service messages about your reservation, and, only if you opt in, program updates. You can unsubscribe from updates at any time.
- To plan the program: understand demand for specifications, colors and regions in aggregate.
- To operate and secure the Site: deliver pages, prevent spam, fraud and duplicate reservations, and fix problems.
- To improve the Site: if you allow analytics cookies, understand how visitors use the Site.
- To meet legal obligations: comply with law, respond to lawful requests and enforce our terms.
We do not use your personal information for automated decision-making that produces legal or similarly significant effects.
5. How we disclose information
We disclose personal information only as described below:
- Service providers who process it on our behalf and under contract, such as website hosting, form processing, email delivery, customer support and (if you allow it) analytics. They may use it only to provide services to us.
- Authorized sales partners. When your build slot comes up, we may pass your contact details and preferences to a licensed dealer or affiliated sales entity in your state so it can complete your purchase, if you choose to proceed. We will tell you before we do this.
- Advertising partners, only if you switch on marketing cookies. See section 6.
- Legal and safety reasons: to comply with law, legal process or a government request, or to protect the rights, property or safety of us, our users or others.
- Business transfers: in connection with a merger, acquisition, financing or sale of assets, subject to this policy's protections.
- With your consent or at your direction.
6. Sale and sharing of personal information
We do not sell personal information for money, and we have not done so in the past 12 months.
Some US state laws treat disclosing online identifiers to advertising partners for cross-context behavioral advertising or targeted advertising as "sharing" or a "sale". This happens on the Site only if you switch on marketing cookies. You can opt out at any time by:
- using the Your Privacy Choices page;
- turning off marketing cookies in ; or
- enabling a Global Privacy Control (GPC) signal in your browser. We treat GPC as a valid opt-out request for that browser.
We do not knowingly sell or share the personal information of consumers under 16 years of age.
7. Cookies and similar technologies
We use a strictly necessary cookie to remember your cookie choices. Optional analytics and marketing cookies are only set after you allow them, and you can change your choices at any time. Full details are in our Cookie Policy.
The Site loads fonts from Google Fonts. When it does, Google receives your IP address and basic browser information so it can deliver the font files. See Google's Fonts privacy FAQ.
8. How long we keep information
| Information | How long we keep it |
|---|---|
| Reservation details and preferences | Until you cancel your request or the Series One program ends, then up to 24 months to resolve disputes and meet legal obligations, after which we delete or anonymize it. |
| Program update subscription | Until you unsubscribe. We keep a suppression record of your email so we don't email you again. |
| Messages you send us | Up to 24 months after we resolve your inquiry. |
| Privacy request records | 24 months, as required by California regulations. |
| Hosting and security logs | Up to 90 days, unless needed longer to investigate a security incident. |
| Cookie consent record | 180 days in your browser, after which we ask again. |
9. How we protect information
We use administrative, technical and physical safeguards appropriate to the information we hold, including encryption in transit (HTTPS), access controls limited to people who need the data, and contracts that require our service providers to protect it. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a breach affects your personal information, we will notify you as required by law.
10. Your choices
- Emails: use the unsubscribe link in any program update, or email us. We will still send messages about your reservation while it is active.
- Cookies: change your choices at any time in Cookie settings, or through your browser.
- Global Privacy Control: we honor GPC signals as described in section 6.
- Do Not Track: there is no common standard for "Do Not Track" browser signals, so we don't respond to them. We do respond to GPC.
- Cancel your reservation: email [email protected] at any time.
11. Your US state privacy rights
Depending on where you live, state law may give you rights over your personal information. These include California (CCPA, as amended by the CPRA) and states such as Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia. - Right to delete personal information, subject to legal exceptions.

13. How to exercise your rights
You can submit a request by:
- using the request form on Your Privacy Choices; or
- emailing [email protected] with the subject line "Privacy request".
Verification. To protect you, we verify requests to know, correct or delete by matching the information you give us with the information we hold. Usually that means confirming you control the email address on your reservation. We will only use information you provide for verification for that purpose. Opt-out requests don't require verification.
Authorized agents. You may use an authorized agent. We may ask the agent for signed permission from you, and may ask you to verify your identity directly, unless the agent holds a valid power of attorney.
Timing. We confirm receipt within 10 business days and respond within 45 calendar days. If we need more time, we may extend once by up to 45 more days and will tell you why. Requests are free, but we may refuse requests that are manifestly unfounded or excessive.
Appeals. If we decline your request, you can appeal by replying to our decision or emailing [email protected] with the subject line "Privacy appeal" within 60 days. We will respond within the time your state's law requires, usually 45 or 60 days. If you are not satisfied with the outcome, you may contact your state Attorney General.
14. Children's privacy
The Site is intended for adults. You must be 18 or older to request a reservation. We do not knowingly collect personal information from children under 13, and we do not knowingly sell or share personal information of anyone under 16. If you believe a child has given us personal information, contact us and we will delete it.
15. Visitors outside the United States
The Site and the Series One presale are intended for residents of the United States. If you visit from elsewhere, your information will be processed in the United States, where data protection laws may differ from those in your country. Where the law of your country applies (for example, the GDPR in the European Economic Area or the UK GDPR), we rely on your consent, on steps needed to take your request before entering into a contract, on our legitimate interests in operating and securing the Site, and on legal obligations. You may contact us to exercise the rights available to you under that law, and you may complain to your local data protection authority.
16. Changes to this policy
We may update this policy from time to time. We will change the "Last updated" date at the top and, if the changes are significant, notify reservation holders by email before they take effect. Earlier versions are available on request.
