Please read these Terms carefully. By using roadster-presale.us you agree to them. If you don't agree, please don't use the Site.
1. About these Terms
These Terms of Use ("Terms") are an agreement between you and Roadster Presale ("we", "us" or "our") and govern your use of roadster-presale.us and any related pages, forms and emails (the "Site"). Reservation requests are also governed by our Reservation Terms, which form part of these Terms. Our Privacy Policy explains how we handle personal information.
2. Eligibility
You must be at least 18 years old to use the Site's forms. The Series One presale is open to residents of the United States. By using the Site, you confirm that you meet these requirements and that the information you give us is accurate.
3. Information on the Site
Roadster Series One is a pre-production vehicle. Specifications, performance figures, features, colors, prices, availability and timing on the Site are preliminary targets and estimates. They may change without notice and do not form part of any contract. Performance figures are estimates obtained under controlled conditions. Illustrations are artist's drawings and may not reflect the production vehicle.
Nothing on the Site is an offer to sell a vehicle, a promise to build or deliver one, or financial, legal or tax advice. A vehicle may only be purchased under a separate written purchase agreement, through a seller licensed as required by the laws of your state.
4. Reservation requests
Submitting a reservation request is free and non-binding for you. We do not collect payments or card details through the Site. The Reservation Terms explain how requests are handled, allocated and cancelled.
5. Acceptable use
You agree not to:
- submit false information, impersonate someone else, or submit requests on someone's behalf without their permission;
- use bots, scripts or other automated means to submit forms or reserve slots;
- sell, transfer or advertise a reservation or a place in line;
- interfere with the Site's security or operation, including by uploading malicious code, probing for vulnerabilities without our permission, or overloading the Site;
- scrape, copy or harvest content or data from the Site, except as allowed by standard search engine indexing;
- use the Site in violation of any law or in a way that infringes anyone's rights.
6. Intellectual property
The Site and its content, including text, illustrations, graphics, designs, logos and software, are owned by us or our licensors and protected by copyright, trademark and other laws. You may view and print pages for your personal, non-commercial use. You may not otherwise copy, modify, distribute or create derivative works from the Site without our written permission. "Roadster Series One", "S/01" and related logos are our trademarks. Other names may be trademarks of their respective owners.
7. Your submissions and feedback
You keep ownership of the information you submit. You give us permission to use it as described in our Privacy Policy. If you send us ideas or suggestions about the vehicle or the Site, you agree we may use them without any obligation to you.
8. Third-party links and services
The Site may link to or rely on third-party websites and services, such as font providers. We don't control them and aren't responsible for their content or practices. Your use of them is subject to their own terms.
9. Disclaimers
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ANY VEHICLE WILL BE PRODUCED OR DELIVERED ON ANY PARTICULAR SCHEDULE OR WITH ANY PARTICULAR SPECIFICATION.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE OR A RESERVATION REQUEST. BECAUSE THE SITE AND RESERVATIONS ARE FREE, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THEM WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100).
Some states don't allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
11. Indemnity
To the extent permitted by law, you agree to indemnify and hold us harmless from claims, losses and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your breach of these Terms.
12. Governing law and disputes
These Terms are governed by applicable US federal law and the laws of your state of residence, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us at [email protected] and try to resolve the dispute informally for at least 30 days. If it isn't resolved, either of us may bring the claim in a court of competent jurisdiction in your state of residence. This section does not limit any right you have under the consumer protection laws of your state of residence.
13. Changes to the Site and these Terms
We may change, suspend or discontinue any part of the Site at any time. We may update these Terms; the new version takes effect when posted, and we will change the "Last updated" date above. If the changes are material, we will notify reservation holders by email. Continuing to use the Site after changes take effect means you accept them.
14. Suspension and termination
We may suspend or block access to the Site, or cancel reservation requests, if we reasonably believe you have breached these Terms or the Reservation Terms, or to protect the Site or other users.
15. General
These Terms, together with the Reservation Terms and Privacy Policy, are the entire agreement between you and us about the Site. If any provision is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets.
16. Copyright complaints
If you believe content on the Site infringes your copyright, send a notice under the Digital Millennium Copyright Act to [email protected] including: your contact details; a description of the copyrighted work; the URL of the material; a statement that you have a good-faith belief the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and that you are authorized to act for the copyright owner; and your physical or electronic signature.
