Reservation Terms

1. What a reservation is

A reservation request ("Reservation") is a request to be invited, in turn, to configure and, if you choose, buy a Roadster Series One vehicle. It records your place in line. It is not a purchase, an order, a contract to buy or sell a vehicle, or a guarantee that a vehicle will be built or delivered to you. These Reservation Terms are part of our Terms of Use.

2. No payment

Reservations are free. We do not collect deposits, fees or card details through roadster-presale.us or by email. If anyone asks you to pay to secure, upgrade or speed up a Reservation, it isn't us. Please don't pay, and forward the message to [email protected].

If a deposit is ever required at a later stage, for example when you place a vehicle order, it will be explained in a separate written agreement that states the amount, the conditions under which it is refundable, and the seller's identity. You will need to accept that agreement before you pay anything.

3. Who can reserve

• You must be at least 18 years old and a resident of one of the 50 US states or the District of Columbia.
• One Reservation per person. Duplicate requests will be merged and only the earliest will count.
• The information you provide must be accurate and your own. Reservations made with false details, on someone's behalf without their permission, or by automated means may be cancelled.

4. Order of allocation and invitations

Reservations are ranked by the date and time we receive them. When the configurator opens, we will email invitations in that order. Each invitation will say how long you have to respond. If you don't respond in time or decline, your Reservation will be released and the next person in line will be invited. We may invite reservation holders in batches and may allocate Launch Edition vehicles first, in reservation order.

Allocation may also depend on whether a vehicle can be legally sold and registered in your state, and on production capacity. We do not promise any particular build or delivery date.

5. Specifications, pricing and timing

Specifications, features, colors, estimated prices and timelines shown on the Site are preliminary and may change before production. Final pricing and specifications will be presented to you before you are asked to sign a purchase agreement. Estimated prices exclude destination charges, taxes, title, registration, dealer fees where applicable, and options.

6. No guarantee of production

Vehicle programs can be delayed, changed or cancelled. If the Series One program is materially delayed or cancelled, we will notify reservation holders by email. Because a Reservation is free and non-binding, we have no further obligation to you in that case, other than handling your personal information as described in our Privacy Policy.

7. Buying a vehicle

If you choose to proceed when invited, the purchase will be made under a separate purchase agreement with the seller identified in that agreement, which may be a dealer licensed in your state where state law requires it. That agreement, not these Reservation Terms, will govern the price, payment, delivery, warranty and your cancellation rights.

8. Changing or cancelling your Reservation

You can update your preferences or cancel your Reservation at any time, free of charge, by using the link in your confirmation email or by emailing [email protected] from the address you used to reserve. Changing your preferences does not affect your place in line. Cancelling does, and cannot be undone. A new request would join the end of the line.

9. Cancellation by us

We may cancel a Reservation if we reasonably believe it breaches these Reservation Terms or our Terms of Use (for example, false details, duplicate or automated requests, or attempts to resell), if we can't verify your contact details, or if we can't lawfully offer the vehicle in your state. We will tell you by email if we cancel your Reservation.

10. No transfer or resale

Reservations are personal and can't be sold, transferred or assigned, except to a spouse or domestic partner at our discretion on written request. Any attempt to sell or advertise a Reservation or place in line may result in cancellation.

11. Communications

By reserving, you agree that we may send you service emails about your Reservation, such as confirmations, invitations and material program changes. We will send marketing emails only if you opt in, and every marketing email includes an unsubscribe link. We will not send you marketing text messages or automated calls.

12. Privacy

We handle the personal information in your Reservation as described in our Privacy Policy. We do not sell it.

13. Changes to these Reservation Terms

We may update these Reservation Terms. We will change the "Last updated" date above and email reservation holders about material changes. Changes will not affect your place in line. If you don't agree with a change, you may cancel your Reservation at any time.
